Laws on giving birth in the Unites States regulate doctor and midwives in practicing their professions in order to properly help pregnant women deliver their babies. These laws on giving birth aim to promote safe and efficient birthing, while protecting the health of the mother and the new born baby.
The creation of laws on giving birth was implemented in order to prohibit unlawful practices of many midwives who continue to give their service despite the prohibition imposed no them in some states. Many states in the US do not recognize the authority of midwives to deliver babies and once midwives are caught engaging in such service, prosecution is likely. To them, such a practice can endanger the life of the mother and baby, especially if the health conditions of the expecting mother are not great.
There are also certain states in US like Arizona , Arkansas , Florida , Idaho , Iowa , Kansas , Maine , Nebraska , Texas and Utah that adhere to the services of midwives and allow them to practice their profession in their locality. Some of the pregnant women who are bound to deliver soon may arrange assistance of midwives provided it is legal in their state. Because giving birth at home is not an unlawful act, a pregnant woman may deliver her baby in the comfort of her own home if she wishes.
States like Alabama , California , Connecticut , Georgia , Illinois , Kentucky and Massachusetts have some controversial issues with their laws of giving birth, especially those pertaining to services of midwives. It would be wise for a pregnant woman in residence of these states to check and verify the labor law applicable to their state. The same goes to residents of states like Minnesota , Mississippi , Montana , New Jersey , Rhode Island , Virginia , Wisconsin and Michigan .
States that definitely do not allow the practices of midwives include Colorado, Delaware, Hawaii, Indiana, Louisiana, Maryland, Missouri, New York, North Carolina, Ohio, Pennsylvania and West Virginia.
